El peritaje es un medio de prueba. Desde la historiografía, se ha estudiado como referente de la monopolización que la mirada médica ejerció desde aproximadamente 1930 en el proceso judicial. Desde entonces, el peritaje se ha concebido como medicalizado. Si bien esto explica el proceso mediante el cual el conocimiento médico se inserta en los procesos penales, no agota la comprensión del peritaje, puesto que deja por fuera la reflexión sobre otros conocimientos que se involucran en el informe pericial. Para (...) explicar qué es el peritaje y qué tipo de conocimientos se involucran en él, a partir de una investigación de corte documental, este artículo realiza una lectura del peritaje desde la codificación como una expresión relacional de la experticia. Para hacerlo, propone un análisis de la codificación penal y procesal colombiana desde el año de 1873 hasta el año de 1980, con el fin de evidenciar que sus articulados traducen una visión del legislador donde el perito se muestra como una figura relacional en medio de conocimientos, partes, actuaciones procesales y decisiones del juez. Todo esto con el fin de demostrar que la concepción del peritaje debe entenderse en relación con la experticia y con la capacidad que tiene el perito de relacionar y validar su conocimiento en el proceso judicial. Neste trabalho de cunho teórico, buscamos analisar a dinâmica dos afetos na perspectiva filosófica de Baruch Espinosa. Ao projetar esse objetivo, procuramos trazer elementos que favoreçam análises da compreensão escolar como espaço de potencialização. Defendemos como considerações finais do estudo que essa perspectiva e entendimento são nucleares para o debate e compreensão da dinâmica dos afetos no processo de humanização.

The present paper seeks to expose the recent problematic disclosed by some authors like Gerardo Aboy Carlés and Soledad Montero, among others, about Ernesto Laclau’s work, which has traced a new analytical path whose goal is to study with accuracy what kind of political identity-logic is the populist one. With a broader discourse perspective and understanding populism as an identity management, we consider the use of the concept of populism relevant in order to revise historical cases such as the one (...) leaded by Jorge Eliécer Gaitán in Colombia in the middle of the 20th century. In this text we contrast the populist identity with others more related to the use of force and the physical elimination of the adversary, suggesting to study gaitanist identity as one that configures ítself in an ambivalent game which oscillates between the call to radical belligerency and the privileged use of expressions pertaining to the democratic tradition which moderated the totalitarian elements of Gaitan’s speech. In this vein, we open to discussion the mostly obliterated relationship between violence and populism, with the hope to contribute to a more accurate characterization of the populist phenomenon in Latin America. Los derechos de la infancia son de formulación reciente, y hasta el siglo XX no surgen los primeros intentos de reconocerlos y regularlos. Además de revisar los textos jurídicos que formulan y protegen esos derechos a nivel mundial, este estudio promueve una lectura filosófica de los derechos de la infancia y del papel de las familias con respecto a esos derechos. La ética del cuidado proporciona un marco de reflexión muy oportuno para plantear la responsabilidad ética que las familias, y (...) la sociedad en general, tienen hacia los niños y niñas, que son los miembros más vulnerables de la sociedad y los que padecen con mayor crudeza las consecuencias de la pobreza, la migración o los desastres naturales. Este estudio lleva a cabo una revisión crítica sobre los derechos de la infancia y los principales intentos de reconocer y garantizar jurídicamente esos derechos a nivel internacional. Explora también la situación actual de la infancia a nivel mundial, enfatizando las consecuencias negativas de la pandemia de COVID-19 en ese sector vulnerable de la población. Por último, se adopta la perspectiva de la ética del cuidado para analizar las responsabilidades de las familias y el papel de las instituciones y de la sociedad en general hacia la protección de la infancia. Este trabajo parte de la noción filosófica de alteridad, que se puede complementar con las aportaciones de la teoría feminista y su reflexión sobre la diferencia sexual. Hay, al menos, tres aspectos del pensamiento feminista que interesa destacar a propósito de la alteridad: en primer lugar, la crítica a la construcción de lo femenino como alteridad con respecto a lo masculino; en segundo lugar, y de la mano del feminismo de la diferencia, es interesante reflexionar sobre las experiencias físicas y (...) simbólicas de la maternidad, que proporcionan un nuevo modelo de ‘alteridad irreductible’ y nuevos contenidos para una ética del cuidado; en tercer lugar, y partiendo de las consideraciones de Ricoeur sobre la dialéctica entre identidad y mismidad, la alteridad sexual puede ser reformulada como una construcción dinámica articulada a partir de la tensión entre las dimensiones discursivas y performativas. Este artículo reflexiona acerca de las especificidades de la constitución de los monumentos conmemorativos en vínculo con la historia reciente. Para ello, la mirada se centrará en la noción de contramonumentos, entendiendo a estos últimos como aquellas producciones que, inicialmente de la mano de un grupo de artistas alemanes, desafían las premisas del monumento tradicional. En base a esto, se expone, en primera instancia el desarrollo histórico del monumento, destacando determinados sucesos que se consideran significativos dentro de la extensa cronología (...) en la que éste se inscribe; en un segundo momento, se recuperan una serie de reflexiones y debates que problematizan y cuestionan la efectividad de estos objetos culturales en relación a la evocación del pasado; y finalmente, se presentan y analizan un conjunto de producciones artísticas que se enmarcan dentro de lo que se reconoce como contramonumentos. En este sentido, se considera que la revisión de los aspectos formales, conceptuales y funcionales a partir de las cuales James E. Young definió en la década de los noventa a los contramonumentos, ilumina y habilita nuevas reflexiones sobre las diversas intervenciones, acciones de resistencia y producciones artísticas que se llevan a cabo en la actualidad, muchas de las cuales pueden ser pensadas como contramonumentos. La escritura para la reflexión pedagógica es una competencia profesional docente que debe ser desarrollada durante la formación inicial para que, posteriormente, pueda ser aplicada en diversos contextos educativos, enriqueciendo así el proceso de enseñanza y aprendizaje tanto del propio profesor como de los estudiantes con los que este interactúa. El ámbito de formación práctica es un espacio curricular donde esta competencia asume mayor preponderancia, pues el futuro profesor debe transferir diversos conocimientos teóricos hacia el ejercicio de aula. Bajo este (...) contexto, es posible reconocer la producción y circulación de ciertos géneros escritos específicos que dan cuenta de esta competencia. Esta investigación tiene como objetivo principal caracterizar, desde una perspectiva socioretórica, los géneros de reflexión pedagógica que escriben los estudiantes de dos carreras de pedagogía de una universidad chilena durante su formación práctica. Desde un enfoque metodológico cualitativo y con un diseño de Estudios de Casos Múltiples, se aplicaron dos instrumentos de recolección de datos: entrevistas semiestructuradas y focus group a profesores y estudiantes de la carrera de Educación Especial y Educación Parvularia. Entre los principales resultados destacan el reconocimiento de la escritura como un recurso que recoge la reflexión pedagógica de los profesores en formación; la utilización de determinados géneros pedagógicos en cada carrera y además la existencia de una progresión en el uso de estos de acuerdo a la complejidad y avance en el recorrido formativo del Plan de Estudios. Perfazemos em linhas gerais os deslocamentos operados por Foucault para estabelecer uma determinação recíproca entre experiência e pensamento.

En el presente trabajo examino la tesis de José María Sauca sobre la “liquidez constitucional” y las cláusulas de este tipo que identifica en la Constitución Española. Propondré analizarlas a la luz de la tesis de la cláusula alternativa tácita presentada por Kelsen.

In this paper, I argue for two main hypotheses. First, that self-control is not a natural mental kind and, second, that there is no dedicated mechanism of self-control. By the first claim, I simply mean that those behaviors we label as “self-controlled” are a somewhat arbitrarily selected hodgepodge that do not have anything in common that distinguishes them from other behaviors. In other words, self-control is a gerrymandered property that does not correspond to a natural mental or psychological kind. By (...) the second claim, I mean that self-controlled behaviors are not produced by a mechanism that is not utilized in the production of other behaviors. Not only is there no natural mental property of self-control, there is no mechanism that is dedicated to producing self-controlled behavior. I further evaluate whether this account of self-control has enough explanatory power to account for a range of phenomena related to self-control. I argue that my account does a better job of explaining these phenomena than accounts which appeal to a dedicated self-control mechanism. (shrink)

Situationism is, roughly, the thesis that normatively irrelevant environmental factors have a great impact on our behaviour without our being aware of this influence. Surprisingly, there has been little work done on the connection between situationism and moral luck. Given that it is often a matter of luck what situations we find ourselves in, and that we are greatly influenced by the circumstances we face, it seems also to be a matter of luck whether we are blameworthy or praiseworthy for (...) our actions in those circumstances. We argue that such situationist moral luck, as a variety of circumstantial moral luck, exemplifies a distinct and interesting type of moral luck. Further, there is a case to be made that situationist moral luck is perhaps more worrying than some other well-discussed cases of moral luck. (shrink)

Alfred Mele presents an influential argument for incompatibilism which compares an agent, Ernie, whose life has been carefully planned by the goddess Diana, to normal deterministic agents. The argument suggests both that Ernie is not free, and that there is no relevant difference between him and normal deterministic agents in respect of free will. In this paper, I suggest that what drives our judgement that Ernie is not free in the Diana case is that his actions are merely an extension (...) of Diana's—he is akin to a tool, which she uses solely for her own purposes, and his behaviour occurs only because of the interest Diana takes in its occurring. This contrasts with normal deterministic universes, in which normal agents are not such tools. (shrink)

Situations are powerful: the evidence from experimental social psychology suggests that agents are hugely influenced by the situations they find themselves in, often without their knowing it. In our paper, we evaluate how situational factors affect our reasons-responsiveness, as conceived of by John Fischer and Mark Ravizza, and, through this, how they also affect moral responsibility. We argue that the situationist experiments suggest that situational factors impair, among other things, our moderate reasons-responsiveness, which is plausibly required for moral responsibility. However, (...) even though we argue that situational factors lower the degree of our reasons-responsiveness, we propose that agents remain moderately reasons-responsive to the degree required for moral responsibility. Nonetheless, those affected by situational factors are arguably less morally responsible than those who are not subject to similar situational factors. We further evaluate an understanding of reasons-responsiveness which relativizes reasons-responsiveness to agents’ circumstances. We argue that the situationist data do not warrant this kind of divergence from Fischer’s and Ravizza’s account. We conclude by discussing what situationist experiments tell us about our relationship to non-reasons. (shrink)

El presente estudio ofrece una aportación en ese sentido, para ello parte de los planteamientos éticos contemporáneos relacionados con el cuidado y analiza varios textos de Unamuno a la luz de ese marco teórico. El resultado es una lectura novedosa de su obra donde se identifica la presencia de aspectos vinculados a la eticidad del ser-para-otro, se plasma el ejercicio (...) del cuidado ejercido a través del lenguaje y del tacto, y se profundiza en el alcance ético de la actitud maternal omnipresente en los relatos del bilbaíno. This article reflects on transhumanism and its promise to achieve bodies which will be forever young, healthy, and highly useful. From a critical approach mainly based on feminist theory, it recalls different points against this promise, as they can work as criteria for exclusion and could end up in a denial of the body and its main features. The paper starts with some reflections on the application of biotechnologies in order to enhance human bodies. It also recalls the discussion on (...) virtual realities and their promises to erase the limits of the body and cancel materiality. Posthuman discourses end up in a proposal to leave behind the ‘burden’ of the body. Some feminist scholars have claimed against these arguments, and have asked for a ‘return to the body’ instead, as its denial can harm the vindications of equality, freedom and abolition of sexual discrimination. The Coronavirus Disease 2019 pandemic prompted the need for a teleneuropsychology protocol for the cognitive assessment of older adults, who are at increased risk for both COVID-19 and dementia. Prior recommendations for teleneuropsychological assessment did not consider many of the unique challenges posed by COVID-19. The field is still in need of clear guidelines and standards of care for the assessment of older adults under the current circumstances. Advantages of teleneuropsychological assessment during the COVID-19 pandemic include reduced risk of contracting (...) the virus, eliminating travel time and reducing cost, and more rapid access to needed services. Challenges include disparities in technology access among patients, reduced control over the testing environment, impeded ability to make behavioral observations, and limited research on valid and reliable cognitive assessment measures. The aim of this perspective review is to propose a teleneuropsychological protocol to facilitate neuropsychological assessment utilizing a virtual platform. The proposed protocol has been successful with our clinical and research populations and may help neuropsychologists implement teleneuropsychology services without compromising validity or reliability. However, there is increasing need for research on teleneuropsychological assessment options for both clinical and research purposes. (shrink)

In this paper, I argue that some intentional actions are not triggered by proximal intentions; i.e. there are actions which are intentional, but lack relevant proximal intentions in their immediate causal history. More specifically, I first introduce various properties of intentions. I then argue that some actions are triggered by mental states which lack properties typically ascribed to intentions, yet these actions are still intentional. The view that all intentional actions are triggered by proximal intentions is thus false.

I argue that we do not intentionally and rationally shape our character and values in major ways. I base this argument on the nature of transformative experiences, that is, those experiences which are transformative from personal and epistemological points of view. The argument is roughly this. First, someone who undergoes major changes in her character or values thereby undergoes a transformative experience. Second, if she undergoes such an experience, her reasons for changing in a major way are inaccessible to her (...) beforehand. Third, if such reasons are inaccessible beforehand, she cannot act on them and thus cannot rationally and intentionally shape her character or values. Libet’s timing experiments have resulted in some strong and unsavoury claims about human agency. These range from the idea that conscious intentions are epiphenomenal to the idea that we all lack free will. In this paper, I propose a new type of response to the various sceptical conclusions about our agency occasioned by both Libet’s work and other experiments in this testing paradigm. Indeed, my argument extends to such conclusions drawn from fMRI-based prediction experiments. In what follows, I will provide (...) a brief description of these experiments, sketch arguments one may be tempted to draw on their basis, and argue that such arguments rely on a questionable premise: that experimental subjects have relevant proximal intentions. Allí los aspectos góticos de la corporeidad decadente encuentran una formulación futurista en que la crueldad resulta alentada. En la complementariedad y la tergiversación de las estéticas, el cuerpo se desintegra en un espectáculo que combina lo grotesco y lo fúnebre. The alternatives of illness trace a taxonomy in which the responsibility of the individual seems choice the organic failures. Since 1981, Chilean universities experienced profound transformations outlined by what some authors call the New Public Management. Released to the market and mandated to modernize their management systems under an entrepreneurial spirit, the universities went from being providers of a social right, such as education, to becoming an institution that provides educational services. Under the figure of the self-entrepreneur, this article examines the transformations that Chilean university student movements have experienced in the last fifteen years. Specifically, the changes in their (...) demands, tactics and strategies of struggles are problematized, showing the performative effects of the neoliberal order on the subjectivities of the students and the way in which they link with the new teaching subjectivity. Instituted in 2004, the Czech Republic research assessment has since changed on an annual basis. In this paper I examine how researchers in the Czech Republic negotiate research assessment. Using the concept of epistemic living spaces, I first set in context the Czech research assessment system and second explore the micro-politics of resistance in which researchers engage in their daily conduct. Empirically, I draw on individual and group interviews carried out with Czech researchers in the humanities, social sciences and natural (...) sciences, analyses of science policy documents including the Methodology for Evaluating Research, Development and Innovation Results, as well as public debates relating to research assessment, such as blogs and newspaper articles. The interviews were carried out between 2007 and 2010. Additional sources of data include participant observation at public events and seminars on the research and development system reform, research assessment and audit of the Czech system of research, development and innovation gathered between 2009 and 2011. Este texto corresponde a una versión ligeramente extendida de la presentación leída en el lanzamiento del libro _La Universidad (im)posible_, publicado por Ediciones Macul, realizada el 10 de mayo de 2019 en el Salón Juan Gómez Millas de la UMCE. El volumen reúne la mayoría de los trabajos presentados en el Coloquio Internacional “La Universidad posible”, realizado en Santiago de Chile, entre el 18 y el 21 de abril de 2016, incluyendo contribuciones de quienes se hicieron parte de la convocatoria, (...) pero no pudieron estar presentes. Ampliando las resonancias de la fórmula nietzscheana que da nombre a la segunda de sus consideraciones intempestivas, en las que el golpe de martillo recae sobre la utilidad y el perjuicio de la historia para la vida, intentamos esbozar una clave de lectura que permita recorrer los diversos envites de este libro desde la atención al malestar que se aloja hoy en la universidad, anudado a su devenir corporativo y a la gramática de una existencia sofocada por el lenguaje_ _del neoliberalismo. Viendo resquebrajarse la idea que la universidad tenía de sí misma, su transformación exige a quienes la habitamos volver a tensar los hilos que la anudan con la vida y con la muerte, para no conceder simplemente a las prácticas que, por los poderes y lógicas que la asedian y conforman, esta institución actualmente alberga. Si la vida queda excluida de la universidad, como vislumbra Walter Benjamin en su ensayo temprano sobre _La vida de los estudiantes, _la tarea recae en activar las facultades de la contienda para inventarse una nueva, _otra _universidad posible, una en la que el pensamiento, la imaginación y el deseo puedan volver a rastrillar lo que queda de porvenir en la memoria de ese nombre. _Palabras Clave: _Universidad – Vida – Neoliberalismo – Crítica. The thesis of situationism says that situational factors can exert a signi cant in uence on how we act, o en without us being consciously aware that we are so in uenced. In this paper, I examine how situational factors, or, more speci cally, our lack of conscious awareness of their in uence on our behavior, a ect di erent measures of control. I further examine how our control is a ected by the fact that situational factors also seem to (...) prevent us from becoming consciously aware of our reasons for action. I argue that such lack of conscious awareness decreases the degree of control that agents have. However, I propose that while being in uenced by situational factors in such ways may impair and diminish one’s control, it (typically) does not eradicate one’s control. I further argue that being in uenced by situational factors, in the way set out above, also decreases one’s degree of moral responsibility. (shrink)

Su trabajo con los Libros de Artista fue muy importante pues es considerado uno de los pioneros en México al experimentar en ese campo y junto con otros artistas e intelectuales, impulsó su propagación.
